I. General Provisions
1. The "Rules of Ethical Conduct of Civil Servants Serving in the Ministry of Digital Development and Transport (hereinafter referred to as the Ministry)" (hereinafter referred to as the Rules) have been developed in accordance with Article 21.2.8 of the Law of the Republic of Azerbaijan "On the Rules of Ethical Conduct of Civil Servants" and paragraph 2 of the Decree of the President of the Republic of Azerbaijan No. 614 dated August 16, 2007 "On the Application of the Law of the Republic of Azerbaijan "On the Rules of Ethical Conduct of Civil Servants".
2. The Rules specify the rules of ethical conduct of civil servants serving in the Ministry and the guarantees related to their observance.
3. Each civil servant serving in the Ministry (hereinafter referred to as the civil servant) shall, in his/her official conduct, comply with the Law of the Republic of Azerbaijan "On the Rules of Ethical Conduct of Civil Servants", as well as these Rules related to his/her activities related to the Ministry. is obliged.
4. The main purpose of these Rules is to increase public trust in the Ministry and civil servants serving in the Ministry, to increase the efficiency of civil servants' activities, and to achieve compliance with the rules of ethical behavior by civil servants.
II. Principles of ethical behavior of civil servants
5. Principles of ethical behavior of civil servants:
5.1. Principle of respect for the rights, freedoms, legitimate interests, honor and dignity, and business reputation of people - A civil servant must not forget that the main purpose of his activity is to serve the provision (protection and defense) of the rights, freedoms, and legitimate interests of people.
5.2. Principle of legality - A civil servant must strictly comply with the requirements of the Constitution of the Republic of Azerbaijan, international treaties to which the Republic of Azerbaijan is a party, laws of the Republic of Azerbaijan, and other normative legal and regulatory acts of a normative nature when performing his duties.
5.3. Principle of conscientious behavior - A civil servant must effectively perform his official duties in the interests of people, society, and the state. is obliged. A civil servant shall be an example of honesty for every person in all cases.
5.4. Principle of loyalty - A civil servant shall refrain from critical public opinions, speeches and public assessment of the activities of the Ministry and other state bodies, their heads (except for illegal activities) in cases not related to his official duties. This rule does not apply to speeches or scientific writings of a civil servant related to his scientific and pedagogical activities. A civil servant shall protect his honor and dignity under all circumstances, be faithful to his oath, not allow actions that are incompatible with the performance of his duties related to service and may harm his name, as well as lower the reputation of the Ministry and the civil servant, and shall refrain from actions that give the impression of a violation of any ethical norms. A civil servant shall comply with generally accepted national moral norms.
5.5. Principle of cultural behavior - A civil servant shall be courteous to all persons with whom he comes into contact, including his direct and superior supervisor, colleagues or Be polite, kind, attentive and restrained in his behavior with subordinates. A civil servant must accept, evaluate and draw correct conclusions from remarks and criticisms related to his professional activities.
5.6. Principle of impartiality - A civil servant must be impartial when performing his duties, including when making decisions, and at the same time must not allow the superiority of any person or group of persons based on race, nationality, language, gender, social origin, property and service status, attitude to religion, beliefs, membership in a public or other association, or create conditions for obtaining such superiority. A civil servant is obliged to adhere to political neutrality when performing his duties.
5.7. Principle of public trust - A civil servant is obliged to strengthen the reputation of the Republic of Azerbaijan, the Ministry and the civil service, and to uphold the name, honor and dignity of a civil servant. A civil servant He/She shall refrain from places and contacts with persons that may harm the reputation of the Ministry and the civil service. A civil servant shall eliminate the consequences of his/her violation of the rules of ethical conduct and take measures to restore public trust. A civil servant shall assist representatives of the mass media in informing the public about the activities of the Ministry and its officials in obtaining accurate (honest) information in cases and in accordance with the procedure established by law.
5.8. Principle of execution of orders, orders or instructions - A civil servant is obliged to execute a written order, order or oral instructions given by his direct or superior superior that are in accordance with the law and within the scope of his authority. If a civil servant is sure that an order, order or instruction given to him by his direct or superior superior contradicts the law or other normative legal act, he must submit a written justification to his direct or superior superior. He must request that this order, order or instruction be confirmed in writing by his direct superior. If, despite receiving an order, order or instruction confirmed in writing by his direct superior, a civil servant continues to believe that they contradict the law or other normative legal act, he may refuse to execute such order, order or instruction. Failure to comply with legal instructions shall entail disciplinary liability.
5.9. The principle of non-admission to obtaining material and non-material benefits, privileges or concessions - It is prohibited for a civil servant to take actions (inaction) or make decisions aimed at illegally obtaining material and non-material benefits, privileges or concessions. A civil servant must take measures to exclude the possibility that his actions (inaction) or decisions lead to obtaining material and non-material benefits, privileges or concessions. A civil servant who provides free service(s) to individuals in accordance with the procedure established by law may not demand any fee for that service(s). A civil servant who provides service(s) to citizens in exchange for payment established by law may not demand a fee exceeding the amount provided for that service(s).
5.10. Principle of use of property - A civil servant must use state property, financial resources, communication, computer and other communication systems, vehicles and other material and technical equipment in his/her use economically and efficiently. A civil servant is prohibited from using state property, financial resources, communication, computer and other communication systems, vehicles and other material and technical equipment for personal interests, as well as for other purposes not related to the performance of official duties by that civil servant.
5.11. Principle of use of information - A civil servant must ensure the possibility of obtaining and disseminating information at the disposal of the state body he/she serves in the manner established by legislation. A civil servant must comply with the rules for the provision of official information established by the state body. A civil servant may not use information obtained during his/her service activities for personal interests.
5.12. The principle of increasing professionalism and individual responsibility - A civil servant must deeply understand the responsibility of his service duty, improve his qualifications, and civil servants holding leadership positions must also take measures to increase the theoretical knowledge and professionalism of their subordinates. A civil servant must study the existing legislative acts related to the performance of his service duties. A civil servant must increase and strengthen the trust of legal entities and individuals in the Ministry and the public service as a whole through his ethical behavior and professional activities.
III. Service behavior of a civil servant
6. A civil servant:
6.1. must not allow procrastination while performing his service duties and must not create conditions for the occurrence of such situations;
6.2. must not refuse to receive citizens without reason, must carry out the reception of citizens in the cases determined by his immediate superior, if a person has not applied for it, he must advise him on where to apply, and respond to the received applications on their merits;
6.3. must observe the culture of speech, listen to people patiently when communicating with them;
6.4. must respect the opinions of civil servants and citizens;
6.5. must speak in the state language when performing official activities, except in cases of necessity;
6.6. must not claim that the work performed jointly or by another civil servant was performed by him/her;
6.7. must not create obstacles to the performance of official activities by another civil servant;
6.8. must perform his/her official duties carefully, accurately and professionally, and at the same time must be principled, impartial, objective and responsible;
6.9. must not allow actions that lead to a violation of the work regime during working hours (speaking loudly, abuse of the use of the official telephone);
6.10. must comply with executive and labor discipline, as well as adhere to the work schedule, arrive at work on time, not spend working time on extraneous matters, not allow cases of evasion from work for an unjustified reason and not leave the workplace without the permission of the immediate supervisor;
6.11. must not come to work in a state of intoxication after consuming alcoholic beverages, narcotics, toxic and other poisonous substances, as well as must not be in a state of intoxication after consuming such beverages or substances at the workplace after coming to work;
6.12. must dress in the manner determined by the management, keep their appearance clean and neat, except in cases related to official necessity;
6.13. must not smoke in places where smoking is prohibited, as well as in public places where official duties are performed;
6.14. must not allow disputes arising between them to damage the reputation of the Ministry and the civil servant;
6.15. not to allow discrimination and acts of violence when performing his/her official duties;
6.16. not to create tension in the collective and take measures to resolve any misunderstandings that arise at the initial stage;
6.17. not to use offensive and threatening expressions against civil servants and citizens;
6.18. not to disseminate information that is not true and that damages or may damage the reputation of a civil servant in the management and collective;
6.19. not to threaten another civil servant for any of his/her actions for his/her own purposes and interests;
6.20. not to use his/her official position to induce another civil servant to act (inaction) contrary to the law;
6.21. to observe the rules of subordination and subordination in service relations with civil servants working in managerial positions;
6.22. to regularly inform the management about the implementation of assigned tasks;
6.23. shall inform his/her immediate superior (in advance) about participation in events related to his/her official duties and the results of those events;
6.24. shall not receive any compensation for assistance or advice provided on issues related to his/her official duties;
6.25. in the event that, during the implementation of the legislation in state bodies or the implementation of the rules of ethical conduct of civil servants, a civil servant is assigned to investigate the case of his/her close relatives or persons with whom he/she has a personal relationship, he/she shall inform the management in order to change the object of the investigation;
6.26. If a civil servant is a member of the interview group (commission) in a close relationship, personal affinity, dependency, personal enmity with any of the candidates, or if there are circumstances that may negatively affect the objective assessment or violate other principles of the interview, he/she must inform the management in order to be excluded from the interview;
6.27. When making decisions during the performance of his/her official duties, he/she must not be influenced by factors unrelated to the issue;
6.28. He/she must resolutely prevent attempts to influence him/her in matters related to the performance (non-performance) of his/her official duties, and if there is reason to suspect the existence of such attempts, he/she must not accept any gifts, favors, payments, etc. from anyone in any form, and must immediately inform his/her immediate superior about this;
6.29. He/she must not interfere in official matters that are not directly related to the performance of his/her official duties, he/she must not try to influence the resolution of issues related to the official duties of other employees, and he/she must not show interest in issues and documents that are being processed without official necessity;
6.30. should not seek ways contrary to the established rules for promotion, remuneration, and obtaining privileges, and should firmly reject the intervention of outside intermediaries in this matter;
6.31. should resolve the conflict of interest that arises between personal interests and official duties in the name of public interests;
6.32. should take measures against behavior that does not comply with business rules and ethical conduct rules;
6.33. should be demanding towards oneself and colleagues, and if any civil servant serving in the Ministry encounters cases of violation of ethical conduct rules, should take measures to eliminate them, and if necessary, inform the relevant authorities about this;
6.34. should inform the immediate superior in case of misunderstanding in relations with any person regarding uncivilized behavior;
6.35. If he/she considers the given task to be unethical or illegal, he/she must immediately contact the superior who gave the task and clarify the task;
6.36. must protect the confidentiality of information obtained in connection with his/her official activities even after working hours;
6.37. must not give direct interviews to the press and, when receiving an interview offer, must direct the request to the responsible person;
6.38. must officially disclose information about any work related to the activities of a state body only if authorized by the superior;
